Terms of Service
Effective date: July 30, 2026
Welcome to YummyYucky. These Terms of Service are a legal agreement between you and YummyYucky LLC, a Delaware limited liability company ("YummyYucky," "we," "us," or "our").
These Terms govern your use of YummyYucky, including our website, mobile applications, food library, tracking tools, caretaker-sharing features, community features, reports, price tools, and paid subscription features. We refer to all of these together as the "Service." Please read these Terms carefully. We have tried to write them in plain English.
By clicking a button or checking a box that says you agree to these Terms, creating an account after being shown these Terms, purchasing a subscription, or otherwise using the Service after being given clear notice of these Terms, you agree to them. If you do not agree, do not create an account, purchase a subscription, or use the Service.
Our Privacy Policy explains how we collect, use, protect, and share personal information. It is part of your relationship with YummyYucky and should be read together with these Terms.
1. Who may use YummyYucky
YummyYucky is intended for adults, including parents, legal guardians, family members, nannies, childcare providers, and other authorized caretakers.
You must be at least 18 years old, or the age of legal adulthood where you live, to create an account.
YummyYucky is not intended for children to create accounts or use directly. A parent or authorized adult may enter information about a baby or child as permitted by these Terms and our Privacy Policy.
By creating an account, you represent that you are legally able to agree to these Terms, the information you provide is accurate, you are authorized to enter any information you submit about a baby or child, and you will use the Service only for lawful purposes.
2. YummyYucky is not medical advice
YummyYucky is a tracking, education, and inspiration tool. It is not a doctor, dietitian, emergency service, medical device, diagnostic service, or substitute for professional medical care.
Nothing in YummyYucky diagnoses, treats, prevents, monitors, predicts, or cures any medical condition. This includes our food information, allergen tools, reaction logs, watch windows, reminders, reports, summaries, recommendations, and community content.
Our features may rely on general educational information, rules or settings built into the Service, information entered by you or another caretaker, information from outside sources that may later change, and automated calculations or summaries. They do not involve a healthcare professional evaluating your baby's individual condition.
Always consult your pediatrician or another qualified healthcare professional about introducing foods or allergens, a baby's nutritional needs, feeding delays or difficulties, choking concerns, possible allergic reactions, medical conditions, and any symptom or behavior that concerns you. Do not wait for an app reminder or watch window before seeking help.
Emergencies
YummyYucky does not provide emergency monitoring or emergency care. If a baby has trouble breathing, swelling of the lips, tongue, or face, repeated vomiting, loss of consciousness, unusual unresponsiveness, severe lethargy, signs of choking, or any other potentially serious symptom, contact emergency services immediately. Do not rely on YummyYucky to determine whether a symptom is serious.
3. Accounts and account security
You are responsible for keeping your login information secure, using accurate account information, updating your information when it changes, activity performed through your account, and promptly telling us if you believe your account has been compromised.
Do not share your password. Use YummyYucky's caretaker invitation features when you want another person to have access.
We may require identity, account, or authority verification before processing requests involving sensitive information, profile ownership, account recovery, deletion, or access disputes.
4. Baby profiles and caretaker access
YummyYucky may allow users to create profiles for babies or children and invite other caretakers to participate.
Profile Owners
The person who creates a baby profile is normally its initial "Profile Owner." YummyYucky may allow an additional parent, guardian, or authorized person to become a Profile Owner. A Profile Owner may be able to invite or remove caretakers, choose caretaker permissions, add, edit, or delete information, export information, request deletion of the profile, and transfer ownership where the Service permits it. Available permissions may change as the Service develops.
Creating a profile does not establish legal parentage, custody, guardianship, or any other legal right concerning a child.
Your authority
You may create or manage a baby profile only if you are the child's parent or legal guardian, acting with authorization from a parent or legal guardian, or otherwise legally permitted to enter and manage the information. You may invite a caretaker only if you are authorized to give that person access.
Do not use YummyYucky to secretly monitor another person, obtain information without permission, interfere with custody rights, or evade a court order.
Caretakers
An invited caretaker may be able to view, add, edit, or manage information depending on the permissions granted. Caretakers must use the profile only for authorized caregiving purposes, enter information honestly and carefully, respect the privacy of the child and other caretakers, stop accessing the profile when their permission ends, and avoid sharing information outside YummyYucky unless authorized.
Removing a caretaker ends that person's future access through YummyYucky. It cannot erase screenshots, exports, messages, or other copies the person previously created outside the Service.
Conflicting requests and family disputes
YummyYucky is not a court, custody evaluator, or family mediator. We do not determine who should have custody or decision-making authority over a child. If we receive conflicting instructions concerning a profile, we may temporarily limit, preserve, or freeze access, ask for identity or authority documentation, preserve relevant account records, follow a valid subpoena, court order, or legal requirement, decline to make changes until the parties resolve the dispute, or take another reasonable step to protect the child, users, and Service.
We will try to act fairly, but we cannot guarantee that we can resolve every family or caretaker dispute. Where appropriate, the Service may maintain a history of profile access or changes. Users should not assume every action can be reversed.
5. Information and content you submit
"User Content" means information you or your caretakers submit to YummyYucky, including feeding, sleep, diaper, bottle, and reaction logs; baby and caretaker information; notes and reminders; photographs; recipes and food ideas; comments and community posts; and reports, messages, and other material.
You keep ownership of your User Content, subject to any rights another person may have in that content. You represent that you have the right to submit the User Content, that submitting it does not violate another person's privacy, intellectual property, contractual, or other rights, that you have appropriate permission before submitting another person's photograph or personal information, and that your content does not violate these Terms or applicable law.
Private User Content
For User Content that you keep private or share only with invited caretakers, you give YummyYucky a limited license to host, copy, process, organize, transmit, display, back up, and otherwise use that content only as reasonably needed to provide the Service you request, make the content available to authorized users, maintain, secure, troubleshoot, and support the Service, comply with law, enforce these Terms, and protect users and the public.
This license is nonexclusive and worldwide because our technology and service providers may operate in more than one location. The license generally ends when the content is deleted from our active systems, subject to reasonable backup periods, legal obligations, fraud prevention, security records, dispute preservation, and information that has already been shared outside YummyYucky.
Public User Content
If you choose to publish User Content through a community or public feature, you give YummyYucky a nonexclusive, worldwide, royalty-free license to host, copy, display, distribute, format, moderate, and promote that content in connection with YummyYucky. This allows us, for example, to show your public recipe in the community, resize an uploaded image, or feature a useful public contribution within YummyYucky.
You may remove public content using available tools. Removal may not immediately eliminate cached copies, quotations by other users, material already shared outside YummyYucky, or records we must retain for legal or safety reasons.
Our data commitments
Unless we obtain separate, clear, and express permission from you, we will not sell your private baby information, use private baby information for cross-context behavioral advertising, use private baby information to train a general-purpose artificial intelligence model, or publicly identify a baby or family using private User Content.
We may use information that has been aggregated or deidentified so that it does not reasonably identify a person or baby to understand and improve the Service, conduct safety and quality analysis, and produce general insights. We will not attempt to reidentify information that we treat as deidentified except to test whether our deidentification protections work or as permitted by law.
Our Privacy Policy provides additional details and controls.
6. Community features
YummyYucky may allow users to share recipes, food ideas, feeding experiences, comments, photographs, or other content publicly. Community content is created by users. It may not be reviewed by YummyYucky or a healthcare professional.
Community content is not medical advice, a guarantee that a food is safe, a personalized feeding plan, a substitute for reading product labels, or an endorsement by YummyYucky.
Before following a community recipe or suggestion, consider allergens, choking hazards, texture and preparation, age and developmental readiness, sodium and added sugar, honey and other age-restricted foods, ingredients that may have changed, and your baby's medical history and individual needs.
Community rules
Do not post content that is knowingly false or dangerously misleading, encourages unsafe feeding or medical practices, is abusive, threatening, hateful, or harassing, sexually exploits or endangers a child, reveals private information without permission, infringes intellectual property rights, contains malware, scams, spam, or deceptive promotions, violates law or another person's rights, impersonates another person, or interferes with another family's lawful use of the Service.
We may investigate, label, restrict, remove, preserve, or report content or accounts when we reasonably believe doing so is necessary to enforce these Terms, protect users, address a complaint, or comply with law. We are not required to monitor every post and cannot guarantee that all inappropriate content will be found immediately.

7. Copyright complaints
YummyYucky respects intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated copyright agent containing the information required by applicable law.

We may remove or restrict access to disputed material. Where appropriate, we may terminate users who repeatedly infringe intellectual property rights. A person whose content was removed may be permitted to submit a counter-notice as provided by law. Submitting a knowingly false infringement notice or counter-notice may create legal liability.
8. Food, allergen, and reaction tracking
YummyYucky may help users track foods and ingredients, common allergens, feeding dates and times, possible reactions, symptoms, notes, watch windows, and caretaker observations.
These features are organizational tools only. They do not predict, detect, diagnose, prevent, confirm, or rule out an allergic reaction or other medical condition.
The accuracy of the history depends on what users enter. A history may be incomplete or inaccurate because a feeding was not logged, a caretaker entered the wrong information, a symptom appeared later, the baby ate something unknown, an ingredient or product formulation changed, two caretakers entered conflicting information, a notification was delayed, missed, or disabled, or the Service experienced an error or interruption.
Always independently confirm ingredients, preparation, feeding instructions, and medical guidance.
9. Reports and summaries
YummyYucky may generate feeding summaries, food histories, allergen histories, reaction histories, caretaker handoffs, shareable reports, cost summaries, and other automatically organized information. These reports are based primarily on User Content. They are not created or verified by a healthcare provider.
They are not diagnoses, clinical assessments, prescriptions, or substitutes for medical records maintained by a healthcare professional. Review every report for accuracy before sharing or relying on it.
You decide whether to share a report with a pediatrician, daycare, family member, caretaker, or other person. Once information is shared outside YummyYucky, we may not be able to control how the recipient stores, uses, or rediscloses it.
10. Prices, products, and affiliate links
YummyYucky may display or help users track diaper or formula prices, package sizes, estimated spending, product availability, discounts or promotions, and links to outside retailers.
Prices, taxes, shipping charges, promotions, package sizes, ingredients, availability, and product descriptions may change without notice. Retailers, manufacturers, and other third parties, not YummyYucky, control their products, labels, inventory, fulfillment, warranties, recalls, and final prices.
Always verify the final price, package quantity, product ingredients, allergen warnings, age recommendations, safety notices, recall information, and whether the product is appropriate for your family.
Some product links may be affiliate links. This means YummyYucky may receive a commission if you purchase through the link, at no additional cost to you. Affiliate compensation does not change our safety guidance. Where reasonably possible, we will place a disclosure near affiliate content rather than relying only on these Terms. Unless expressly stated, YummyYucky does not endorse or warrant a third-party product.
11. Free and paid features
YummyYucky may offer both free and paid features. Paid features may be offered through a subscription such as YummyYucky Plus.
Before you subscribe, we will show you the material terms of the offer, including as applicable the price, billing frequency, subscription length, whether the subscription renews automatically, the length and terms of any trial or promotional period, the price that applies after a trial or promotion, how to cancel, and any material limitations on the offer. By completing the purchase, you expressly authorize the recurring charges described at checkout.
Automatic renewal
Unless you cancel, a subscription automatically renews at the end of each billing period at the price disclosed to you, subject to any properly disclosed price change. We will provide purchase confirmations, renewal reminders, trial notices, annual reminders, price-change notices, and other notices when required by law.
How to cancel
If you subscribed directly through YummyYucky's website, you may cancel future renewals online from the Plus page in your account by choosing "Manage subscription," which opens the billing portal where you can cancel.
If you subscribed through Apple, Google Play, or another platform, you must manage and cancel the subscription through that platform's subscription controls. Deleting or uninstalling the YummyYucky app does not cancel a subscription.
Deleting your YummyYucky account will cancel future renewals if YummyYucky bills you directly, but may not cancel a subscription billed by Apple, Google Play, or another platform. Before completing account deletion, we will remind you when a third-party subscription may require separate cancellation.
Cancellation stops future renewals. Unless required by law or the applicable platform's rules, you may continue using paid features through the end of the already-paid billing period.
Refunds
Payments are generally nonrefundable after the billing period begins, except where required by law, where required by the billing platform's policies, where we expressly promise a refund, or where we determine that a refund is fair under the circumstances. Submitting a refund request does not automatically cancel future renewals.
Price and plan changes
We may change subscription prices, included features, or plan structures. We will provide advance notice of material changes when required by law. A price increase will not take effect for an existing billing period. You may cancel before a change takes effect. If a paid feature is permanently discontinued, we may provide a replacement feature, account credit, prorated refund for directly billed service, or another reasonable remedy.
Payment providers
Payments may be processed by Apple, Google, Stripe, or another payment provider. The provider's terms and privacy practices may also apply. You agree to provide accurate billing information and authorize the applicable provider to collect the disclosed charges and taxes.
12. Privacy and security
Our Privacy Policy explains what information we collect, why we collect it, how we use and disclose it, how long we keep it, the service providers we use, your privacy rights, how to request access, correction, export, or deletion, and how to contact us about privacy.
We use reasonable administrative, technical, and physical safeguards appropriate to the information we maintain. No online service can guarantee perfect security. You are responsible for using a strong password, protecting your devices, and promptly reporting suspected unauthorized access.
Our employees and contractors may access User Content only when reasonably necessary to provide requested support, maintain or secure the Service, investigate misuse, comply with law, or carry out another purpose described in our Privacy Policy. If we experience a security incident, we will investigate and provide notices when required by applicable law.
13. Exporting and deleting information
Available export and deletion options may depend on your account role and the way a baby profile is shared. Before deleting an account or profile, download any information you want to keep.
Shared profiles
Deleting your own account may not delete information from a shared baby profile if another authorized Profile Owner continues to use that profile. A Profile Owner's request to delete a shared profile may affect other caretakers. We may notify other authorized Profile Owners, require verification, or temporarily preserve the profile while resolving conflicting requests.
What deletion means
When a valid deletion request is completed, we will delete or deidentify covered information from active systems as described in our Privacy Policy.
Some information may remain for a limited period in encrypted backups, billing and tax records, fraud and security records, legal records, records needed to resolve disputes, content already shared publicly or with others, and deidentified or aggregated information. We may retain information longer where required or permitted by law.
14. Suspension and termination
You may stop using YummyYucky at any time. We may restrict, suspend, or terminate an account or profile if we reasonably believe that these Terms were materially violated, the account was used without authority, a child or user may be at risk, the Service was abused or attacked, fraud or illegal activity occurred, continued access creates a security or legal risk, or we are required to do so by law.
Where circumstances permit, we will provide notice and a reasonable opportunity to correct the problem or appeal the decision. We may act immediately where necessary to address security, fraud, child safety, unlawful conduct, or an urgent risk.
If we permanently terminate a directly billed paid account for a reason unrelated to the user's misconduct, we will provide a prorated refund for the unused portion of the billing period where reasonably practicable. If an account is terminated because of a violation of these Terms, refunds are not guaranteed except where required by law. Termination does not eliminate obligations that arose before termination.
15. What you may not do
You may not:
- Use YummyYucky to provide emergency or professional medical care.
- Present YummyYucky content as a diagnosis or individualized medical advice.
- Create or access a baby profile without authority.
- Use another person's account without permission.
- Secretly monitor another person.
- Impersonate another person or misrepresent your authority.
- Submit content that violates law or another person's rights.
- Submit malicious code or interfere with Service security.
- Probe, scan, attack, overload, or disrupt the Service.
- Circumvent access controls.
- Reverse engineer the Service except where applicable law expressly permits it.
- Scrape, harvest, copy, or bulk-download substantial portions of the Service without permission.
- Resell or commercially exploit the Service without permission.
- Use YummyYucky content or private user information to create or train a competing product, model, or dataset.
- Use automated systems in a way that imposes an unreasonable load.
- Use community features for spam, scams, harassment, exploitation, or deceptive promotion.
- Help another person do any of these things.
Reasonable indexing by search engines that follow our published technical instructions is not prohibited.
16. YummyYucky content and intellectual property
YummyYucky owns or licenses the protectable elements of the Service, including software and code, branding and trademarks, original text and guides, graphics and designs, original photographs and illustrations, the selection, arrangement, and presentation of our food library, and other content created by or for YummyYucky.
Basic facts, ideas, methods, and information that are not legally protectable do not become our exclusive property merely because they appear in the Service.
We give you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service for your personal or family caregiving purposes. This license does not permit you to republish substantial portions of the Service, sell or sublicense access, remove proprietary notices, use our trademarks in a way that suggests endorsement, create a competing copy of the Service, or use the Service for unauthorized commercial purposes. Your ownership of User Content is not transferred to us.
Feedback
You may send us ideas or suggestions. You are not required to do so. If you submit feedback, you allow us to use it without restriction or payment, provided that we do not publicly identify you as its source without permission. Do not submit confidential business information as feedback.
17. Third-party services
YummyYucky may link to or work with third-party services, including app stores, payment processors, retailers, analytics providers, hosting providers, authentication services, and email or notification providers. Those services may have their own terms and privacy policies.
We are not responsible for a third party's service, products, security, availability, content, or conduct, except to the extent the law makes us responsible. A link does not automatically mean that YummyYucky endorses the third party.
18. Apple App Store and Google Play terms
If you download or purchase YummyYucky through an app store, that platform's terms also apply.
Apple
For an application obtained through Apple's App Store: these Terms are between you and YummyYucky, not Apple; YummyYucky, not Apple, is responsible for the application and its content; Apple has no obligation to provide maintenance or support; if the application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the application, if any, and to the maximum extent allowed by law Apple has no other warranty obligation; YummyYucky is responsible for addressing claims relating to the application, including product-liability, legal-compliance, consumer-protection, and intellectual-property claims; you must comply with applicable third-party terms when using the application; and Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the application and may enforce those provisions.
Google Play and other platforms
For an application obtained through Google Play or another platform: these Terms are between you and YummyYucky unless the platform's terms say otherwise; platform billing, cancellation, refund, and account rules may apply; and YummyYucky remains responsible for the Service to the extent required by applicable law and platform rules.
Export restrictions
You represent that you are not prohibited from using the Service under applicable United States export-control or sanctions laws.
19. Changes to the Service
We may update, improve, limit, replace, suspend, or discontinue features. Features may change because of user feedback, safety concerns, technical limitations, vendor changes, legal requirements, or business decisions.
We will try to provide reasonable notice before permanently discontinuing a material paid feature, unless immediate action is needed for security, legal, or safety reasons. Not every feature will always be available on every device or in every location.
20. Service availability and warranties
YummyYucky is provided "as is" and "as available."
We work hard to make the Service accurate, useful, and reliable, but we cannot promise that it will always be accurate or complete, available without interruption, free of errors, compatible with every device, secure from every possible threat, or suitable for every child or family.
To the fullest extent permitted by law, YummyYucky disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent legally permitted. Nothing in these Terms eliminates any warranty or consumer right that cannot lawfully be waived.
21. Responsibility for decisions
Parents, guardians, and caretakers make the final decisions about feeding, caregiving, medical treatment, purchases, and safety.
You are responsible for checking the accuracy of logs and reports, confirming ingredients and product labels, choosing appropriate foods and textures, supervising feeding, responding to symptoms, seeking professional or emergency help, and deciding who may access a baby profile.
YummyYucky is not responsible for harm caused by inaccurate or missing user entries, unauthorized caretaker conduct, feeding decisions, failure to seek appropriate care, or reliance on the Service in a way that conflicts with these Terms. This section does not excuse YummyYucky from responsibility for its own conduct where the law does not allow that responsibility to be excluded.
22. Limitation of liability
To the fullest extent permitted by law, YummyYucky and its members, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service. Examples may include lost data, lost profits, loss of goodwill, loss of opportunity, or the cost of obtaining a substitute service.
To the fullest extent permitted by law, YummyYucky's total liability for all claims arising from or relating to the Service will not exceed the greater of the amount you paid directly to YummyYucky for the Service during the 12 months before the event giving rise to the claim, or US$100. These limits apply regardless of the legal theory asserted and even if we were advised that damages were possible.
What is not limited
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, willful injury, a violation of law where liability cannot legally be limited, gross negligence to the extent it cannot legally be limited, death or personal injury to the extent caused by conduct for which liability cannot legally be limited, or any warranty, remedy, statutory damage, or consumer right that cannot legally be waived.
Some jurisdictions do not allow particular damage exclusions or liability limits. In those jurisdictions, the limitations apply only to the extent permitted by law.
23. Indemnification
You agree to indemnify and hold harmless YummyYucky and its members, officers, employees, and contractors from a third-party claim to the extent the claim results from User Content you submitted that infringes another person's rights, your unauthorized creation of or access to a baby profile, your unlawful disclosure of another person's information, your intentional misuse of the Service, or your material violation of these Terms or applicable law.
This obligation does not apply to the extent a claim was caused by YummyYucky's own unlawful conduct, negligence, or breach of these Terms. We will provide reasonable notice of a covered claim. We may control the defense and settlement, using counsel of our choice, and you agree to provide reasonable cooperation. We will not agree to a settlement that requires you to admit wrongdoing or personally pay money beyond your indemnification obligation without your consent, which will not be unreasonably withheld.
24. Resolving concerns and disputes
We would rather solve a problem than fight about it. Before filing a lawsuit (other than a small-claims case or a request for urgent relief), the complaining party should send a written notice describing the person or account involved, what happened, the requested resolution, and relevant supporting information.

The parties will make a good-faith effort to resolve the concern for at least 30 days after receiving a complete notice. This informal process does not prevent either party from seeking urgent relief involving unauthorized access, security, child safety, intellectual property, or another immediate threat.
No forced arbitration
These Terms do not require either party to submit a dispute to private arbitration. Both you and YummyYucky retain the right to use a court with proper jurisdiction.
Governing law
California law governs these Terms, without regard to its conflict-of-law rules. If you live somewhere with consumer rights that cannot legally be waived, those rights continue to apply. The fact that YummyYucky LLC was formed in Delaware does not change the governing-law provision for this consumer agreement.
Courts and small claims
Except where applicable law allows or requires another location, disputes must be brought in the state or federal courts located in Riverside County, California, and each party consents to those courts' jurisdiction. A consumer may bring an eligible claim in small-claims court in Riverside County, California, the county where the consumer lives, or another location permitted by applicable law. Each party is responsible for its own legal fees unless a statute, court order, or other applicable rule requires otherwise.
25. Changes to these Terms
We may update these Terms as the Service and law change. For minor changes, we may post the updated Terms and revise the effective date. If a change materially affects your rights or obligations, we will provide reasonable advance notice through email, the Service, or another appropriate method. Where appropriate, we will ask you to affirmatively agree to material changes before they apply.
Changes involving subscriptions will also be handled according to applicable renewal and billing laws. We may make an immediate change when reasonably necessary to address a security issue, prevent abuse, protect a child or user, comply with law, or correct an obvious error.
A new dispute-resolution provision will not retroactively change the rules governing a dispute of which YummyYucky had already received written notice before the change. Continuing to use the Service after the effective date of a properly disclosed change means you agree to the revised Terms, except where applicable law requires a different form of consent.
26. General terms
Entire agreement
These Terms, the Privacy Policy, and any purchase-specific terms shown at checkout form the agreement between you and YummyYucky concerning the Service. They replace earlier Terms concerning the same subject.
Order of priority
If purchase-specific terms directly conflict with these Terms, the purchase-specific terms control only for that purchase. App-store terms may also control matters that the platform manages, such as platform billing.
Severability
If part of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.
No waiver
If either party does not immediately enforce a provision, that does not permanently waive the right to enforce it.
Assignment
You may not transfer your account or rights under these Terms without our written permission. We may transfer these Terms as part of a merger, acquisition, financing, reorganization, asset sale, or transfer of the Service, subject to applicable privacy and consumer-protection laws.
No agency

Survival
